Affiliate Program Terms

These Affiliate Program Terms ("Terms") govern your participation in the Smith App Studio LLC Affiliate Program ("Program"). By joining and participating in the Program, you agree to comply with these Terms.

1. Program Overview

Smith App Studio LLC offers an affiliate program through Rewardful that allows you to earn recurring 30% commissions by referring customers to our applications. The Program is free to join and available to anyone who meets our eligibility requirements.

2. Eligibility

To participate in the Program, you must:

• Be at least 18 years old
• Have a valid email address and payment method
• Comply with all applicable laws and regulations
• Not engage in illegal or unethical marketing practices
• Not use spam, misleading claims, or other prohibited practices (see Section 5)

3. Commission Structure

Affiliates earn 30% recurring commission on referred customers. Commission is calculated as:

• 30% of the subscription price for each month the referred customer maintains an active subscription
• Commissions continue for the lifetime of the customer relationship (or until the customer cancels)
• No cap on total earnings or number of referrals
• Minimum payout threshold of $50 USD

4. Cookie Duration and Attribution

Referral attribution is tracked through our affiliate platform (Rewardful). Referred customers must sign up within 30 days of clicking your affiliate link to be credited to your account. Only one affiliate link per customer is credited; the first tracked referral receives the commission.

5. Prohibited Marketing Practices

You agree NOT to:

• Use spam, bulk email, or unsolicited marketing
• Make false or misleading claims about our applications
• Bid on trademarked keywords owned by Smith App Studio without authorization
• Send unsolicited SMS, phone calls, or push notifications
• Impersonate Smith App Studio or create misleading brand associations
• Promote our apps through illegal, adult, or harmful content
• Use cookie stuffing or other deceptive attribution methods
• Violate any applicable advertising standards or regulations

Violations may result in immediate suspension or termination of your affiliate account.

6. Payment and Payout

Commission payments are processed through Rewardful and paid out monthly, provided your balance meets the $50 minimum. Payments are issued via direct deposit or your payment method on file. Commission tracking and payouts are the sole responsibility of Rewardful; disputes regarding payment calculations should be directed to Rewardful support.

7. Program Termination

Smith App Studio LLC reserves the right to terminate your participation in the Program at any time, for any reason, including:

• Violation of these Terms
• Engagement in prohibited marketing practices
• Fraudulent activity or abuse
• Inactivity for more than 90 days
• Suspension or termination of Rewardful services

Upon termination, any unpaid commissions will be paid out according to Rewardful's terms. Accrued commissions from referred customers will cease immediately.

8. Intellectual Property

All marketing materials, logos, and content provided by Smith App Studio remain our property. You may use provided materials to promote our apps, but you may not modify, claim ownership of, or misrepresent our brand. You agree to use our trademarks and branding only as authorized in writing.

9. No Exclusive Rights

The Program grants no exclusive rights. You are not authorized to act as an agent, employee, or representative of Smith App Studio. You have no authority to bind us to any commitment or agreement.

10. Modification of Terms

Smith App Studio LLC may modify these Terms at any time. We will notify you of material changes via email or by posting updated Terms on this page. Continued participation in the Program constitutes acceptance of modified Terms.

11. Limitation of Liability

Smith App Studio LLC is not liable for any indirect, incidental, or consequential damages related to your participation in the Program. Our total liability for any claim shall not exceed the total commissions you earned in the preceding 12 months.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from the Program shall first be addressed through good-faith negotiation. If unresolved, disputes will be resolved through binding arbitration or court proceedings in New Jersey.
